Terms of Service

1. Acceptance of Terms

By accessing, registering for, or using DatesofAsia ("the Service"), operated by Asia Dating Network (ABN: XX XXX XXX XXX) ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service. We may update these Terms from time to time. Continued use after changes constitutes acceptance. We will notify you of significant changes via email or site announcement.

2. Eligibility

You must meet all of the following criteria to use the Service:

  • You must be at least 18 years old. By creating an account, you represent and warrant that you are 18 or older
  • You must not have been previously banned from the Service
  • You must not be prohibited from using dating services under the laws of your jurisdiction
  • You must be legally capable of entering into a binding agreement

If we discover that a user is under 18, their account will be immediately deleted.

3. Account Registration and Security

When creating an account, you agree to:

  • Provide accurate, truthful, and current information during registration and in your profile
  • Maintain and promptly update your information to keep it accurate
  • Use a valid email address that belongs to you
  • Keep your password secure and confidential
  • Not share your account credentials with any other person
  • Not create more than one account
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized access or security breach

We reserve the right to verify your identity, age, and the authenticity of your profile information. Accounts with false information may be terminated without notice.

4. User Conduct

You agree to use the Service lawfully and respectfully. You must not:

  • Harass, abuse, threaten, stalk, or intimidate any other user
  • Post or transmit content that is defamatory, obscene, hateful, discriminatory, or promotes violence
  • Impersonate any person, or misrepresent your identity, age, gender, or affiliation
  • Post false, misleading, or deceptive information in your profile
  • Send spam, chain messages, or unsolicited bulk communications
  • Solicit money, promote commercial products or services, or engage in prostitution or escort services
  • Use the Service for any illegal purpose or to facilitate illegal activity
  • Attempt to gain unauthorized access to other users' accounts, our systems, or restricted areas of the Service
  • Use automated scripts, bots, scrapers, or other automated means to access the Service
  • Circumvent, disable, or interfere with security features of the Service, including VPN/proxy detection
  • Collect or harvest personal information of other users
  • Use the Service while using a VPN, proxy, or TOR connection (we actively detect and block these)
  • Create accounts using disposable email addresses

5. Content Guidelines

5.1 Profile Photos

All profile photos must:

  • Show your face clearly (face detection is required for upload)
  • Be recent and accurately represent your current appearance
  • Be photos of you and only you (group photos are not permitted as profile photos)
  • Not contain nudity, sexually explicit or suggestive content
  • Not be copyrighted images you do not have the right to use
  • Not contain contact information, social media handles, or promotional content

All photos are subject to moderation. We may remove photos that violate these guidelines without notice.

5.2 Profile Text and Messages

All content you post, including profile text, messages, chat room messages, and stories, must:

  • Be your own original content or content you have the right to share
  • Not contain sexually explicit material
  • Not promote violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
  • Not include personal contact information (phone numbers, social media handles, email addresses) in public-facing areas such as your profile or chat rooms
  • Be appropriate for a general adult audience

5.3 Stories

Stories are temporary content that expire after 336 hours. All content guidelines apply to stories. Stories may be subject to moderation before becoming visible to other users.

5.4 Chat Rooms (Shout)

Public chat rooms are shared spaces. Messages may be edited or deleted within 5 minutes of posting. Moderators and administrators may edit or delete messages at any time. Repeated violations of chat room guidelines may result in warnings, suspension, or ban.

5.5 Content Removal

We reserve the right to remove any content that violates these guidelines, is reported by other users, or that we determine to be harmful, at our sole discretion and without prior notice.

6. Credits and Virtual Currency

6.1 Purchasing Credits

Credits are a virtual currency used within the Service. Credits can be purchased through Stripe at the prices listed on the Credits page. All prices are in US Dollars (USD). Payments are processed securely by Stripe — we do not store your payment card details.

6.2 Earning Credits

Credits can also be earned through daily login rewards and streak milestones, as described on the Credits page. Earned credit amounts are subject to change at our discretion.

6.3 Using Credits

Credits can be spent on features within the Service, including but not limited to sending gifts to other users and boosting your profile visibility. The cost of features is displayed before purchase and may change from time to time.

6.4 Refund Policy

All credit purchases are non-refundable. By purchasing credits, you acknowledge that you are purchasing a consumable virtual item and that you waive any right of withdrawal or cooling-off period to the extent permitted by law. Credits have no monetary value outside the Service, cannot be exchanged for cash, and are not transferable between accounts.

In exceptional circumstances (such as unauthorized transactions or technical errors), refunds may be issued at our sole discretion. Contact us via the Contact Form if you believe a refund is warranted.

6.5 Credit Expiry and Forfeiture

Credits do not expire while your account is active. If your account is terminated for violation of these Terms, any remaining credits are forfeited. If you close your account and do not reactivate within the grace period, remaining credits are forfeited upon permanent deletion.

7. Profile Boosts

Boosts increase your profile visibility for a limited time. Boost durations are approximate and may vary. Boosts are non-refundable once activated. We do not guarantee any specific number of views, likes, or matches from boosted visibility.

8. Safety and Interactions

DatesofAsia is a platform that facilitates introductions between users. We do not conduct criminal background checks, verify identities beyond basic registration checks, or screen users beyond our standard moderation. You are solely responsible for your own safety when interacting with other users.

We strongly recommend:

  • Meeting in public places for initial in-person meetings
  • Informing a friend or family member of your plans before meeting someone
  • Not sharing sensitive personal or financial information with other users
  • Reporting any suspicious, threatening, or abusive behavior immediately using the in-app reporting system
  • Trusting your instincts — if something feels wrong, disengage and report

9. Reporting and Moderation

You can report profiles, photos, and messages through the in-app reporting system. We review all reports and may take actions including but not limited to: issuing warnings, removing content, temporarily suspending accounts, or permanently banning users. We are under no obligation to disclose the specific actions taken or reasons to either party.

10. Intellectual Property

10.1 Our Intellectual Property

The Service, including its design, features, code, graphics, logos, and trademarks, is owned by DatesofAsia and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

10.2 Your Content

You retain ownership of content you post on the Service (photos, messages, profile text). By posting content, you grant DatesofAsia a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and providing the Service. This license ends when you delete your content or close your account, except where your content has been shared with other users (e.g., messages sent to another user).

10.3 Copyright Complaints (DMCA)

If you believe content on the Service infringes your copyright, please submit a takedown request through our Contact Form (select "DMCA / Copyright Takedown") including:

  • A description of the copyrighted work you believe has been infringed
  • The location (URL or description) of the infringing content on our Service
  • Your contact information (name, email address)
  • A statement that you have a good faith belief that the use is not authorized
  • A statement, under penalty of perjury, that the information you provide is accurate and that you are the copyright owner or authorized to act on behalf of the owner

We will review and respond to valid DMCA notices promptly.

11. Account Closure and Deletion

11.1 Closing Your Account

You may close your account at any time from Settings → Close Account. When you close your account:

  • Your profile is immediately hidden from all other users
  • You will not appear in search results, and no one can view your profile or send you messages
  • You will be logged out immediately

11.2 Reactivation Period

You have 30 days to reactivate your account by logging in. After the reactivation period, your account and all associated data will be permanently deleted and cannot be recovered.

11.3 Data Download

Before closing your account, we recommend downloading your data from Settings → Download My Data. See our Privacy Policy for details on data retention.

12. Suspension and Termination by Us

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in harmful conduct, or for any other reason at our sole discretion. Specifically, we may take action if you:

  • Violate any provision of these Terms
  • Engage in conduct that is harmful to other users, us, or third parties
  • Create multiple accounts or evade a previous ban
  • Use the Service for illegal activities
  • Fail to respond to moderation actions or repeated warnings

If your account is terminated for violation of these Terms, you are not entitled to a refund of any credits, and your email may be added to our blocklist to prevent re-registration.

13. Push Notifications and Communications

By enabling push notifications, you consent to receive browser notifications about new messages, likes, gifts, and other activity. You can disable push notifications at any time from Settings or through your browser settings.

By creating an account, you consent to receive transactional emails (verification, password reset, account notices). You can control notification digest emails in Settings, including turning them off entirely.

14. Third-Party Services

The Service uses third-party services for payment processing (Stripe), email delivery (SendGrid), real-time messaging (Pusher), push notifications (OneSignal), photo verification (Face++), and advertising (Google AdSense). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party services.

15. Advertising

The Service may display advertisements served by Google AdSense or other advertising networks. Advertising cookies are only loaded with your consent (see cookie consent banner). We do not control the content of third-party advertisements and are not responsible for the products, services, or claims made in advertisements.

16. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Any matches, connections, or relationships will result from your use of the Service
  • Other users are who they claim to be
  • Content posted by other users is accurate, reliable, or trustworthy

We are not responsible for the conduct of any user, whether online or offline.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DATESOFASIA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

  • Your use of or inability to use the Service
  • Any conduct or content of any other user
  • Unauthorized access to or alteration of your data
  • Any other matter relating to the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such cases, our liability shall be limited to the fullest extent permitted by law.

18. Indemnification

You agree to indemnify, defend, and hold harmless DatesofAsia and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or any content you post on the Service.

19. Dispute Resolution

If you have a dispute with us, we encourage you to contact us first through the Contact Form so we can try to resolve it informally. If we cannot resolve the dispute informally, both parties agree to attempt mediation before pursuing formal legal action.

20. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Australia, and specifically the State of Western Australia, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Western Australia. Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law or any other applicable mandatory consumer protection legislation.

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DatesofAsia regarding your use of the Service, and supersede all prior agreements.
